Please read these terms carefully before using our website or engaging our services. By using the website at diamondbarsunrooms.com or by requesting services from Diamond Bar Sunrooms & Patios ("Company," "we," "us," or "our"), you agree to the following terms.
By accessing or using this website, or by requesting an estimate or entering into a service agreement with Diamond Bar Sunrooms & Patios, you confirm that you have read, understand, and agree to be bound by these Terms and Conditions. If you do not agree, please do not use this Site or request our services. We reserve the right to update these terms at any time by posting a revised version on this page. Continued use of the Site or our services after changes are posted constitutes your acceptance of the revised terms.
Diamond Bar Sunrooms & Patios is a sunroom contractor based in Diamond Bar, CA. We provide residential sunroom additions, patio enclosures, four-season rooms, screen room installation, deck and patio conversions, custom sunrooms, and related outdoor living space construction and remodeling services.
Services are provided only in the geographic areas we serve. We reserve the right to decline any project request at our discretion without obligation to provide a reason. Nothing on this website constitutes a binding offer to provide services until a written agreement is signed by both parties.
Free estimates are provided following an on-site visit to the project location. Estimates reflect the scope of work and materials discussed at the time of the visit and are not binding until incorporated into a signed written contract.
Prices may change if the scope of work changes after the estimate is provided, if unforeseen site conditions are discovered during construction, or if the cost of materials increases between the date of the estimate and the start of the project. Any changes to price will be communicated to you in writing before additional work is performed.
An estimate does not guarantee availability or scheduling. Project start dates are confirmed only after a contract is signed and any required deposit is received.
Project scheduling is confirmed in writing at the time of contract execution. We make every effort to adhere to agreed schedules, but timelines may be affected by permit processing times, weather, material availability, or circumstances outside our control. We will notify you promptly of any significant schedule changes.
If you need to cancel or reschedule a project, please notify us in writing as soon as possible. Cancellation terms, including any applicable deposit forfeiture, are specified in the signed project contract. Cancellation of a project after work has begun may result in charges for labor and materials already incurred.
We reserve the right to cancel or suspend a project if site access is denied, if payment obligations are not met, or if conditions arise that make it unsafe or impractical to continue work.
Payment terms are set out in the signed project contract. In general, a deposit is required before work begins, with the balance due upon completion unless otherwise agreed in writing.
All invoices are due by the date specified in the contract. Accounts that are not paid on time may be subject to late fees as specified in the contract. We reserve the right to suspend or cease work on any project where payment obligations are not being met.
If a project requires permits, permit fees may be charged separately or included in the contract price - this will be clearly stated in your written estimate and contract.
Any warranties on workmanship or materials will be specified in the signed project contract. Warranties are limited to the terms stated in that document. Nothing on this website constitutes a warranty, express or implied, beyond what is set out in your signed contract.
Manufacturer warranties on materials or products (such as windows, glass panels, or roofing systems) are governed by the respective manufacturers' terms. We will assist you in understanding those warranties, but we are not responsible for fulfilling manufacturer warranty obligations on your behalf.
This website and its content are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Site will be error-free, uninterrupted, or free of viruses or other harmful components.
To the fullest extent permitted by applicable law, Diamond Bar Sunrooms & Patios shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or from any service we provide, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising from a project is limited to the amount you paid us for that specific project. This limitation applies regardless of the form of the claim, whether in contract, tort, or otherwise.
If a dispute arises between you and Diamond Bar Sunrooms & Patios in connection with services we provided or a contract we entered into, we ask that you first contact us directly in writing to describe the issue. We will make a good-faith effort to resolve the matter promptly.
If the matter cannot be resolved through direct communication within 30 days of written notice, both parties agree to attempt mediation through a mutually agreed-upon mediator before pursuing any other legal action. The costs of mediation will be shared equally unless otherwise agreed.
Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court in cases where such relief is necessary to prevent irreparable harm.
These Terms and Conditions and any agreements entered into with Diamond Bar Sunrooms & Patios are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not resolved through the dispute resolution process described in Section 8 shall be brought in the appropriate courts of California.
